Privacy Policy

This policy explains what MAK Digital Design LLC collects when you visit makdigitaldesign.com, contact us, or use our free tools, what we do with it, and the choices you have. We have tried to write it the way we would want to read it.

The short version:

  • We collect what you send us through our forms, and standard usage data about visits.
  • We use it to reply to you, do the work you ask for, and improve the site and our marketing.
  • We do not sell your personal information for money.
  • We use analytics and advertising tools from Google, Meta, and HubSpot, and you can opt out of them.
  • You can ask us to show you, correct, or delete what we hold about you at any time.

Who we are and what this policy covers

MAK Digital Design LLC ("MAK Digital", "we", "us") is an eCommerce design, development, and marketing agency based at 3237 US-206 Unit A, Bordentown, NJ 08505 USA. This policy covers makdigitaldesign.com and the forms, newsletter, and free tools on it. It does not cover the websites of our clients or the third-party sites we link to, which have their own policies.

Information we collect

Information you give us

  • Project and quote requests, and the free SEO audit request. Your name, email address, phone number, company name, website, a description of your project, and any files you choose to attach. If you tick the box, we also record that you agreed to receive text messages.
  • Newsletter. Your email address and the page you signed up on.
  • Email, phone, and meetings. Whatever you tell us when you write, call, or book a call.

Information collected automatically

  • With a form or newsletter signup. Your IP address, your browser type, and the page you sent it from, which we use to prevent spam and abuse.
  • When you browse. Pages viewed, the site that referred you, approximate location derived from your IP address, device and browser type, and similar usage data, collected through the analytics and advertising tools listed under Who we share information with.

Information from the free tools

The AI visibility scan, the speed check, and the schema check save the web address you test, the result, and a scrambled (hashed) identifier derived from your IP address that lets us limit overuse without knowing who you are. The migration audit saves your answers and score, with no contact details. If you then send a form from a results page, the result travels with your message so we can help.

We do not ask for sensitive information such as health data, government identifiers, or payment card numbers through this site, and we ask that you not send it.

How we use information

  • To reply to your request, prepare a quote or audit, and schedule calls.
  • To provide the services you hire us for and to manage our relationship with you.
  • To send the newsletter and occasional updates you signed up for. Every email has an unsubscribe link.
  • To understand how the site is used, fix problems, and decide what to improve.
  • To measure and improve our advertising.
  • To protect the site and our forms from spam, fraud, and abuse.
  • To meet legal, tax, and accounting obligations.

Where the law requires a legal basis, we rely on your consent (for example the newsletter and text messages), on steps taken at your request before a contract and the contract itself, and on our legitimate interest in running, securing, and improving our business.

Cookies and similar technologies

The site itself sets very little:

  • mak_sub_seen. Kept in your browser's local storage, or as a cookie if storage is unavailable, to remember that the newsletter popup has been shown so it does not appear again for about 90 days.
  • WordPress cookies. Set only for people who log in to manage the site.

The analytics and advertising tools we use set their own cookies and similar identifiers to recognize a browser over time. You can block or delete cookies in your browser settings, and the section on your choices and rights lists the opt-outs each provider offers. Blocking cookies does not stop the site from working. Our fonts are served from our own server, and videos load from YouTube only after you press play.

Who we share information with

We do not sell your personal information for money, and we do not give it to other companies for their own marketing. We share it only with:

  • Service providers that host the site, deliver email, store our customer records, and help us measure and advertise, under terms that limit what they can do with it.
  • Professional advisers and authorities when we must, to comply with the law, enforce our agreements, or protect someone's rights or safety.
  • A successor if the business is ever merged or sold, in which case this policy continues to apply to information already collected.

The services that may receive information about your visit or your request are:

  • Google Analytics. Measures visits and how pages are used, with cookies and a pseudonymous identifier. Privacy policy.
  • Meta Pixel. Measures the results of our Facebook and Instagram advertising and can show our ads to people who visited the site. Privacy policy.
  • HubSpot. A marketing and customer relationship tool. It records visits and can store the details of people who contact us. Privacy policy.
  • Google PageSpeed Insights. Runs the speed check. It receives the web address you ask us to test. Privacy policy.
  • YouTube. Hosts our videos. A video loads from YouTube's privacy-enhanced domain only when you press play. Privacy policy.
  • Cloudflare. Delivers the site and filters malicious traffic. When enabled on a form, its Turnstile check confirms a visitor is a person. Privacy policy.
  • Google reCAPTCHA and Akismet. Optional spam checks on our forms. When enabled, they receive the IP address, browser details, and the submission. Privacy policy.
  • Collect.chat. Runs the chat window. It receives what you type into the chat and basic details about your visit. Privacy policy.
  • Apollo. A sales tool that can identify the company a visit comes from, using the IP address and pages viewed. Privacy policy.
  • OneSignal. Sends browser notifications to people who chose to receive them. Privacy policy.

Some state laws describe the use of advertising tools such as the Meta Pixel as "sharing" personal information or as "targeted advertising", even though no money changes hands. You can opt out of that as described below.

Text messages

We send text messages only to people who gave us their mobile number and ticked the consent box, and only about their inquiry or project. Agreeing to texts is never a condition of working with us. Message frequency varies, and message and data rates may apply. Reply STOP to end messages or HELP for help. We do not share mobile numbers or text-message consent with third parties for their marketing.

How long we keep information

We keep inquiry records and attached files for as long as we need them to respond and to keep a record of our business dealings, and we delete them when you ask unless the law requires us to keep them. Attachments are deleted together with the inquiry they came with. Newsletter addresses are kept until you unsubscribe or ask us to remove you. Records from the free tools are kept in aggregate to improve the tools and contain no contact details. Analytics providers keep their data according to their own retention settings.

Your choices and rights

Wherever you live, you can ask us to tell you what we hold about you, correct it, delete it, or send you a copy, and you can opt out of marketing. Email info@makdigitaldesign.com or call 888-553-8776 and we will act on it. We may need to confirm your identity first, and we aim to respond within 30 days. We will never treat you differently for making a request.

Residents of California and of the other US states with comprehensive privacy laws, and people in the European Economic Area and the United Kingdom, have these rights by law, along with the right to opt out of the sale or sharing of personal information and of targeted advertising, to appeal a decision we make about a request, and to complain to their regulator. You can use an authorized agent to make a request on your behalf.

Security

The site is served over an encrypted connection. Form submissions are stored in our content management system, where access is limited to staff who need it; uploaded files are saved under random names, outside the media library. No method of transmission or storage is perfectly secure, so we cannot promise absolute security, but we work to protect what you send us and will tell you if a breach affects your information where the law requires it.

Children

Our services are for businesses. The site is not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has sent us information, contact us and we will delete it.

Visitors from outside the United States

We are based in the United States, and the information we collect is processed there. If you contact us from another country, your information will be transferred to the United States, where privacy laws may differ from those where you live. Where required, we rely on appropriate safeguards for that transfer.

Information we handle for clients

When we build, migrate, or maintain a store, we may handle that store's customer and order data on our client's behalf. That information belongs to the client, is governed by our agreement with them and by their own privacy policy, and is used only to carry out the work. If you are a customer of one of our clients and have a question about your data, please contact that business directly.

Changes to this policy

We update this policy when our practices or the law change. The date at the top shows the latest revision. If a change is significant, we will say so prominently on the site or by email before it takes effect.

The questions we are asked most often about how we handle information.

Do you sell my personal information?

No. We do not sell personal information for money or hand it to other companies for their marketing. We do use advertising and analytics tools that some state laws call "sharing", and you can opt out of those at any time.

What happens to the details I enter in the project form?

They are saved as an inquiry in our system and emailed to our team so we can reply. We also record your IP address and browser to keep spam out. We use the details to respond and, if you become a client, to work with you.

Does this site use cookies?

The site itself stores one small entry to remember that you have seen the newsletter popup. Google Analytics, the Meta Pixel, and HubSpot set their own cookies to measure visits and advertising. You can block them in your browser and the site will still work.

How do I get my information deleted?

Email or call us and ask. We will confirm it is you, delete what we hold unless the law requires us to keep it, and let you know when it is done. We aim to respond within 30 days.

Will you send me marketing texts?

Only if you gave us your mobile number and ticked the consent box, and only about your inquiry or project. Reply STOP at any time and they end.

Do the free tools store the website I test?

Yes. Each tool saves the address tested and its result, with a scrambled identifier that prevents overuse. No name or email is attached unless you choose to send us a form afterward.
